Let's say more accurately that nobody has a clue anymore about the
licensing conditions for the copy of the MacOSX SDK we used there and
attempts to track them down have not gone anywhere.  That is none too
great but somewhat unlikely to get us into hot water.

Opposed to that, we know for sure that the 64bit SDKs are off-limits.
