There's actually code which should detect encrypted private keys (see bug 24030 and http://svn.apache.org/viewvc/httpd/httpd/branches/2.2.x/modules/ssl/ssl_engine_init.c?r1=101154&r2=101878). In your particular case, was the private key encrypted *and* appearing before the cert?
