Of course today HHS issued a proposed modification to the Privacy Rule that would make the consent requirement optional for direct treating providers. Instead those providers must obtain patient acknowledgement of receiving a privacy notice from his or her provider. This should be interesting because many providers are not familiar with the original rule let alone the modification.
On a related note if the auto insurer or workers comp carrier is asking for information from a covered health plan, can the plan release the information without an authorization? Can the definition of payment be stretched that far?
