it's neither. it's a common form of the Common Gull (Cepora nerissa) seen in the siwaliks, lower himalayas and parts of the NE. a lot of you seem to be confounded by the seasonal and individual variation seen in this very common species. for reference, compare your pictures here (and the next few clicks):
