It looks like your patch is empty. I'd love to see the problem
addressed though as I can't reproduce it myself without setting
up an Hardy virtual machine (which in progress but still not
usable).
Since your merge directive contains no public branch nor target
branch I wonder how you generate it, can you tell us which
command you used ?
