Dear Pou, compatriots and friends,
I got a personnel message from Lok Srun requiring to sign a petition for UN
concerning ECCC, I may understand. I don’t know what organize of Khmer rouge
victims he belongs to but as I know there are few committees of Khmer rouge
victims in French that work with ECCC to represent the so-called victims of
Khmer rouge, one is VGKR, represent by Lok Srei Ung Bun Hor and other CVKR of
Lok Chhay Hok Pheng. Both working with people and human right organization
(FIDH - CVIC). Last week FIDH - CVIC and VGKR, organized a work committee in
Paris (Noisiel) – As I see, the committee of Lok Srun mainly requires for
repairing (dommages et interêts à titre recompensatoire) leaving aside the most
important things which are Truth and Justice, most of all the profound moral
prejudice submitted by the victims and their family and their country till
present day. How and how much those who organize this tribunal or extra chamber
count to pay for all the sufferings and crimes submitted by the victims? What
heritage and morality they may leave for humanity?
Of course, I applaud the courage and the noble act of Lok Srei Ung Bun Hor and
other human right organization as well Lok Srun but I may explain why myself
and friends (all first link victims and family of victims of Khmer rouge)
decline to join these originations:
1/Cambodia is a well wrong place to organize the tribunal for this kind of
crime. Killing field is recognized by the whole world as a “genocide” which
means, crime committed by a race or a nation against other one which is the
case Cambodia even it is handled in indirect way. First of all Cambodia is not
an independent country. The Cambodian juridical system is totally under order
and control of the government, itself slave and ordered by those who created
its and maintain it in power - a system which leaves no place justice, no place
credibility and impartiality of things which will seriously condemned and
damage the credibility of this tribunal.
2/Those who organize and have full hand over the tribunal Khmer rouge and its
organization involved, direct or indirect to the crime against Khmer people
this including those are used to role over Cambodia and Cambodian people
actually and who got the white cart from UNO to do anything at its wills in the
organization of this tribunal .
What truth and justice that the victims can wait from this kind of tribunal,
organized and fully handle by those whose hands are soiled with the blood of
the victims? This tribunal is nothing than a judgment of the winners over the
losers. The losers are Khmer people, killed or living, and the winners are
yuons Vietcong and its partners, far or close. As the matter of fact, yuons
Vietcong organized the wide wild pillage of Cambodian national richness in
April 17 1975 and second wild pillage was Jan 7 1979, two big pillages in 5
years crossed. It is an evident sign of winners and losers, the winners pilled
and killed the losers. Now that the losers were killed and continued to be
killed to free land for the winners, we can see the winners come to occupy the
land they robed as the triumph of their crimes. Many people who accept to join
this tribunal come to reason, we have this tribunal or we have nothing and most
of all, most of Khmer rouge leaders who are used as sample and makeup of this
crime are being old and will soon die. I may say, I'm sorry that I cant do
anything. For instant, I have no capacity to change thing in Cambodia even my
heart is bleeding by all inacceptable injustice I witness but at least, I
refuse to join with those criminals or soil my hand in the blood of millions of
innocent Khmer people, victims of yuon ferocious expansionist and genocidal
policy and its partner.

Object: Supplementary measures to assist the international court in Cambodia
(Extraordinary chamber in the Court of Cambodia) and creation an account to
fund the khmer-Rrouge’s victims
To UN’s members, we expose some facts as follows:
1. Chronology facts
Vietnam’s war (before 1970)
Before 1970, a crises in the Cambodia between Kheav Samphan, Hou Nim et Hou
Yun and Ex Cambodia king Norodom Sihanouk, would destabilise the Cambodian
Royaume This crises have bring a civil war and Kheav Samphan, Hou Nim et Hou
Yun have been baptised khmers Rouges.
At the same time, the Vietcong et Vietminh (Vietcong are the rebellions of
the south Vietnamese, Vietminh are the nord Vietnamese) use Cambodian territory
to make war against United state in Vietnam.
Marshal Lon Nol (1970 – 1975)
With enough proves of the Vietcong and Vietminh in Cambodia, the USA request
Norodom Sihanouk to expulse the Vietcong et Vietminh from Cambodia territory.
Prince Norodom Sihanouk won’t and can not act as request by USA. Prince
Norodom Sihanouk have ask Marshal Lon Nol to expulse the Vietnamese. A coup
were organised. Prince Norodom went to Russian and china; Lon Nol authorise USA
to intervener in Cambodia; Lon Nol and the USA expulse Vietcong et Vietminh
from the Cambodian territory.
How ever there is a big mistake. Vietnam Russian and China does not agreed
and request Norodom Sihanouk to return to Cambodia. But, it was not possible.
Civil War (1970 – 1975)
Prince Norodom had jointed then the khmer rouge and associate with the
Vietcon and Vietminh to make war against Lon Not and his ally USA in Cambodia.
The Cambodian army has then composed of Khmers of different ideologies.
Khmers rouges (1975 – 1979)
Prince Norodom Sihanouk has von the war in 1975. The new Government expulsed
Cambodians from different cities. The Khmer rouge’s army obliged the news
Cambodian (The new Cambodian are the Cambodians from the city) to work forced
and execute a mass murder.
Invasion et occupation vietnamienne (1979 – 1989)
After the mass murder, there have crises. Pol Pot takes on power. The nord
Vietnam sent army and occupied Cambodia until 1989.
2. UN and the International Court in Cambodia
UN tries effectively to punish the actors of mass murder. UN has make effort
to install a Court International in Cambodia. Never the less, UN has never
tried to support the victim. The victims are use as witness to accuse what the
tribunal like to do.
There is no justice for the victim. This is a big mistake.
There is another mistake.
The international court in Cambodia are ruling under a Cambodian Government
The court will be influences by the Government The court can not rule as an
independent court according to the international law. The witness will not be
protected effectively. Only a few criminal have been put in trial. The Court
will be impartial. The Court will be used as an instrument for the Government
to eliminate his enemies from the pass. Worse is the fact that the tribunal is
an institute full of corruption.
3.. Conclusion
We conclude that, without any measures supplementary, the justice rule by the
International Court in Cambodia shell not be complete.
Consequently, we ask the UN’s members to accept our complaint and to request
the UN to:
1.. Accredit and mandate the International Court of La Hayes to take
instruction and to accuse any criminal from 1975 to 1989, that have not been on
trial by the International Court in Cambodia;
2.. Authorise any Khmer Rouge‘s victim to make complaint either to the
International court in Cambodia or to the International Court of La Hayes.
3.. Create an account to help the witness and the victim of mass murder in
Cambodia.
