If you would prefer to wait until the paperback is available, the printer has informed me I should have the printed books no later than September 15, 2004. ________________________________________________ ������������������������������������������������ ������������������������������������������������ EXPLAINING DOCUMENTS TO BORROWERS Dear Victoria: I feel negligent in my work in not helping the borrower understand the individual documents better, since they are not having it explained by the Lenders which baffles me. So many borrowers are really in the dark as to what they are signing. I was taught that we were not to explain documents, that we were only there to witness the signing but if there was a pamphlet that they could refer to during the three day right of recission it would make some of them more aware of what they are doing. (Janet D.) ------------------------------------------------------------------------ I feel the same way you do -- but in most states you are prevented from explaining documents to the borrowers. I understand that your heart is in the right place and you have a concern for other people -- but the government and man-made law doesn't. Normally what I do is hand the borrowers a document. I will say something like "This is the Truth in Lending Statement. You need to sign your name on this line� (point at the line). Most of the time, the borrowers never ask any questions. They are normally only concerned with getting the paperwork signed so their loan can close and already know the details of their loan prior to approval. If the borrower stops to look at a piece of paper, I allow them time to do so. If they have a specific question that is not UPL-related, I normally will answer it for them. If I am unsure as to whether to answer to the question will violate UPL or not, I will say "Every loan is unique and different. Let's call the company and find out." Then I will call the signing company and hand the phone to the borrower to ask their question directly and remove myself from the middle. He also held several conferences with the National Notary Association and obtained their approval for the Annie Mae concept. I am so happy to be a part of this project.
