Moorings Dispute

Kennet District Council is taking action against British Waterways over 
the establishment of moorings in an area known as Lady Bridge, as the 
result of complaints by a local wealthy landowner who regards the 
moorings as unsightly.  The landowner has recently gained planning 
permission for a development near the moorings, much to the surprise 
and outrage of many local residents, who consider that he appears to 
have undue sway over the Council.  British Waterways is challenging the 
action being taken by the Council at a planning inquiry, as it believes 
that it does not require planning permission for the establishment of 
moorings on waterways that it runs.  BW is concerned that should the 
Council’s Enforcement Notice be upheld, it might set a precedent that 
would challenge the legality of many more moorings on the BW network, 
and leave many boat-owners with no where to moor their vessel.  BW has 
therefore signified that it will escalate the matter to the High Court 
if necessary.  Local boaters have given evidence to support BW.
