Some dogs are so well trained they don't need to be kept on a lead in  order 
to be under control. If the dog will always instantly respond to command  (and 
react correctly) they are considered to be under close control.
 
It is up to the owner to decide whether or not the dog is trustworthy  enough 
to be allowed off the lead -  and up to the legal system to  decide how wrong 
they are when it all goes horribly wrong.  ;-)
