I would move your location that matches assets above the root location. As long as your root is specified at the server level you don't need to redefine the roots inside the location blocks.
Take a look at: https://github.com/donnoman/cap-recipes/blob/master/lib/cap_recipes/tasks/nginx_unicorn/app.conf That configuration works for me for a number of applications. Lastly can you gist your unicorn.rb and command you are invoking unicorn with?
