As long as the patent is granted, and until someone uses a lot of resources to falsify the patent, you may be fined or worse. You cannot ignore the law when you don't like it, because when you like it someone else might ignore your lawful rights. The best way to protect Care2x is to fight both fights, saying no to software patents and not using patented code.
