Indeed. I did just check with protocol and there's a clause in there that explains how should CAS behave upon successful validation, but nothing on failure.
Could we then consider this a bug, create JIRAs to make the code changes as well as updates to the protocol? I tend to think not I agree on the basis that both are required to perform proxying as described in the protocol, so having one and not the other puts the system in an undefined state.
