There is a bar on the shore of Candlewood Lake and three men left there
shortly after 1 a.m. on July 19 in a new 24-foot Formula (Kevin Sullivan,
30, Jason Wanat, 27, and the boat¹s owner, Richard Layton Jr., 32).
Witnesses saw the boat traveling at a very high rate of speed just before it
slammed into an 18-foot Triton bass boat in a narrow channel. Two of the
Formula occupants were killed, the third had critical injuries and only
emerged from an induced coma after a month. The two in the bass boat
(William D¹Addio, 60, and Michael Iannucci, 35) were only slightly injured.
Our state DEP is in charge of boating, but we have a local patrol authority.
So the victims (from both boats) have now filed an intent to sue because
³The Candlewood Lake Authority and the five towns surrounding the lake are
guilty of willful, wanton and reckless disregard for safety¹ on the lake,
said the attorney representing the estate of Jason Wanat of Redding [one of
the Formula occupants].²
To wit, that the lake authority failed to provide a patrol all night on July
19, even though it provided other patrols, such as ones on the July 4
weekend!
³But the two attorneys said they have also filed papers against FirstLight
Power Resources Inc. -- the owner of Candlewood Lake -- and Down the Hatch
[the bar]. They said they also intend to sue Layton's estate, the organizers
of the bass tournament D'Addio and Iannucci were participating in, and
BassMaster Tournaments, the national bass fishing organization.²
The basic theory we are developing here is that you can drive a high-speed
boat like a maniac and if you crash, it can¹t possibly be your fault.
