Bathersby denied me natural justice: Kennedy

St Mary's South Brisbane administrator Fr Peter Kennedy has formally 
appealed to Archbishop John Bathersby over his removal from the 
parish and is also mulling an unfair dismissal action in Queensland's 
industrial courts.

The Australian reports that Fr Kennedy has begun moves under Catholic 
canon law to thwart his dismissal.

Under a formal appeal made this week to Archbishop Bathersby, his 
ousting could be delayed indefinitely as the case might be determined 
in Rome, before an ultimate decision by the Pope, the paper says.

Fr Kennedy said he was also considering legal advice over possible 
action in Queensland's industrial courts, claiming unfair dismissal.

Fr Kennedy told The Weekend Australian he believed he had been denied 
natural justice by Archbishop Bathersby.

"His letter came as a surprise," he said.

"I had been led to believe that there would be a formal process, 
whereby I could put my case to the archbishop and an investigation 
into the claims against me would be carried out. Archbishop Bathersby 
didn't give me that right and I have moved to appeal under canon law 
and am also looking at civil law."
Yesterday, he also defended his church's social activism, telling 600 
people at St Mary's Sunday Mass that Jesus also was harshly 
criticised for unorthodox behaviour.

"People who are not part of our community will make judgments about 
us because of our so called unorthodox behaviour,'' Fr Kennedy said.

"But we can take heart from the words of Jesus himself, who was 
judged harshly for his unorthodox behaviour - 'By their fruits you 
will know them'."

Meanwhile, a plan to establish an aboriginal tent embassy on the site 
has been postponed until next week, said aboriginal activist Sam Watson.

Mr Watson said many groups had asked to participate in a broad 
coalition to save the St Mary's community and it was decided to start 
the tent embassy on the day Fr Kennedy has been told to depart.

The Australian says that a small party of Raelians, who believe that 
alien beings have intervened in earthly affairs, were also outside St 
Mary's with signs supporting Fr Kennedy.
