Ernie: The one thing that occurs to me by way of a theory is that the reason has been politics. That is, confirmation of a justice requires all sorts of compromises. My best guess is that Catholics, now a majority, have ideal qualities as compromise candidates Why ? I donno, but the idea might be testable. This said, when there was a chance for a supposedly true believer Protestant to make appointments, namely GWB, but it turned out that he simply didn't get much of anything in the cultural department and didn't much care about his Evangelical constituency. Not from malice, from insensitivity and ignorance, plus the wrong kind of advisors in this area. But who appoints advisors ? Three guesses. Except for 2001, and maybe as late as mid 2003, my opinion of him was very low and by the end it sank out of sight. Not literally a dunce, but for the office he held, yeah, a dunce. This is no complaint at all about Roberts and Alioto, for which, my sentiments are "thank God." But surely there are highly qualified Protestant jurists. Who will the WH nominate ? Was there a post-JFK push to get Catholics into appellate courts?
