I believe penetration is a first degree sexual assault. I know of a
case where someone was charged with a third degree sexual offense for
walking up to a clothed woman on the street and sticking his hand into
her crotch. (that was MD). I am not sure that "rape" is strictly
speaking a legal term.

This came up in a conversation yesterday - is it rape only if penetration
occurs? How does sexual assault differ from rape? Ie, why would you get
charged for one and not the other.________________________________
