It's the same in both cases.

The point I was making is that the moral high ground is not achieved
just because you're targeting terrorists, but still killing civilians.
 I was using US law as an example to illustrate the point, not to
literally say that the law requires such charges.

When an innocent loved one is killed, the survivors are not likely to
accept the death as necessary or accidental; they'll likely demand
revenge.

Radicals feed on this anger to convince others to become radical.  It
soon becomes impossible to kill every radical since most efforts to do
so create 10 or 20 more.

In Israel you've got an Arab population that is increasing faster than
the Jewish population.  From a pure numbers perspective Israel cannot
win a war of attrition against Palestinian terrorists.

Mr. Sharon has realized this and so came up with his wall idea.  Mr.
Dinowitz has pointed out that terrorism has fallen near this wall, but
this is just the lull while the Palestinians devise a new tactic - and
they will.

Historically when this happens the casualties increase with the new
tactic which is why the wall will only serve to escalate the violence.
 That is, since terrorists will need to put a bit more effort into
circumventing the wall, they'll want the resulting attack to be that
much more vicious.  (e.g., Buzz Bombs in WWII)

Israel will be that much more outraged, but they'll be unable to
respond any differently than they do now.

If Israel wants peace they'll find a way to replace Mr. Arafat and/or
create a transparent plan for peace that 80% of Palestinians support. 
They shouldn't have to, but life isn't fair.  If they want peace
they'll do what it takes to get it.  If they want more death, they'll
build a wall.
