I don't know the exact wording of my contract off-hand, but I do know
that I regularly spot-check my bandwidth speeds and when I'm not
getting 3mb I call them up to let them know. My understanding is that
the "up to x" used to be what you describe when the plans were
one-size-fits-all, but when they went to a tiered speed/price plan
they are now legally committed to provide the amount of bandwidth the
customer is paying for within reason and the "up to" is now more to
allow for wiggle room with equipment problems than it is for the
shared bandwidth issue.
