Thanks for the good link. I'm familiar with the basic concepts, and I
understand that telcos do oversell.

Perhaps there are different disclosure laws there, but here the ISPs
don't provide that information. I'm quite sure that internally, there
are these kinds of figures used to manage their infrastructure, but
they don't publish them publicly.

I'm not naive enough to think that they expect to operate on 100%
throughput. But my point is that parallel to the technical
implementations, they have some basic consumer legal warrantability of
service implied contracts they have created for themselves by having
tiered service levels. I've even taken advantage of it to get monthly
price breaks and service at various times when they don't meet the
implied warranty of service.
