Of couse if the science disagrees with you then rule by fiat. Look at what the Republicans did with the recent bill regarding late term abortions. When the medical and scientific data showed that there are medically necessary reasons for such an abortion, instead of writing these exceptions into the bill, and pissing off the fundie right, they bill's authors used a Congressional finding instead.
