that's the big question, so far legislation has upheld that satellite, cable and such are off limits to content monitoring because of its pay-as-you go nature. I'm paying for it, therefore I am paying to see X. most of the arguments for regulation stem from the fact that the government "owns" broadcast spectrum and as such should be allowed to censor or monitor content. My own personal beef with govt regulation is that while one can be fined for broadcasting obsceneties, there are no concrete statutes that define what is and is not obscene.
