I don't think so. When you said how come they just agreed to do that you are talking about that review of the case de nove that the court agred to consider doing, then denied, right? That would have been under the new federal law in reference to this case, I believe.
if you are asking about were you right that each appeal can consider the case from scratch, no you are not right and either the person you are asking about this knows less than he thinks he does, OR there is something in the way that you are phrasing the question that is making him say yes.
