If we're talking real world policy I think you have a panel of 3 judges on call for these types of things. In the case last night where you had multiple agents witness the accused meet with and then walk off with a known terror suspect, who he later kills, and there's a missing nuke this guy could possibly ID, I think you fill him full of drugs.
