I heard an interesting argument about this case. The argument goes something
like this:

Robert Novak, who originally exposed Plame, has not been in this pickle, while
Judy Miller, who didn't even write a story about it, only did research, is in
the pickle. Why?

It sounds very much like Novak's source(s) already stepped forward for the
grand jury, and thus Mr. Novak's testimony isn't necessary. Maybe Cooper and
Miller's testimony isn't necessary either, so what this might amount to is an
over-zealous prosecutor following the "Martha Stewart" theory of prosecution.
If you can't get someone for the crime, go after someone/anyone for the
cover-up.

So the question remains, if Novak's source stepped forward, why is the
prosecutor beating up on Miller and Cooper? Is it because he believes that they
may have different sources than Novak? If the do, how much of a secret was it,
anyway? If they had the same sources, why are they still being hassled?

Ultimately, I agree that reporters should not be able to invoke the privilege
when invoking the privilege, in effect, makes them an accessory to a crime. And
journalists ought to know better than to guarantee anonymity to a source in
such a case.
