Yes, in the same way that they were able do deflect the election
debate from the Iraq war to Kerry's record in Vietnam.

However, I do think that the First Amendment issue is quite important. 

Yesterday's Albuquerque Journal had a story about a pending civil case
with similar issues. Wen Ho Lee is suing over leaks to media that, he
says, invaded his privacy. Bill Richardson, current governor of NM,
was then Sec. of Energy in the Clinton administration and has denied
under oath beling the source of those leaks. Watch that space, it's
going the same way and now there is a precedent.
