It's not really illegal... but could be grounds for a lawsuit depending on
the issue.  In any case it's really difficult to prove.  You can choose not
hire somebody because you don't like them.

You can't reject a qualified candidate because of certain things (race,
gender, sexual preference, religion, etc) but you can for many others.  In
the end even those rejecting candidates for illegal reasons can often wiggle
out of it by publicly stating some other reason.

In this case without knowing the issue at hand who knows?  Could a case be
made that somebody with that opinion would find it hard to complete the
tasks of the job?  Or was it purely spite?

In the end if an employer has the choice of several otherwise-qualified
candidates it's not surprising that they would gravitate towards those
candidates who share their opinions.
