Rove apparently didn't know her name and only knew that she worked for the CIA from other journalists, not from classified info.
The way the law is written, in order to be guilty, he would have had to: 1. known she was an undercover agent 2. a. revealed her identity b. for the purpose of exposing her undercover status Number one is virtually impossible to prove unless there is an email that pre-dates his conversation with Cooper that says, "Mr. Rove, Joe Wilson's wife is an undercover CIA agent." Two a. is questionable. What constitutes identity? Give the prosecutor this one. Even so two b. is clearly not true. Cooper's notes state very emphatically that Rove spoke on double secret background- meaning off the record- for the purpose of casting doubt on Wilson's story, not to expose Plame. Cooper broke his word by revealing this information. Journalists can cry about not revealing confidential sources, but if they knowingly reveal information that a source has asked them to keep quiet, at the very least they ought to expect never to get any useful information from the source ever again.
