Well, I think the back talk is part of refusing to do what the office
requests.

If the cop asks you to stop doing something that is illegal, and in effect
refuse in a manner that is less than polite, then you've now broken two
laws.

You've broken the law, and then informed him that you planned on continuing
to break the law.

It isn't that you don't have the right to say it. You aren't being jailed
because you said it, you are being jailed because you refused the request.
