H1-B's aren't automatic, but they're not hard to get, all you need is an American employer who wants cheap tech labor (no I'm not a fan of h1-B visas when there are this many unemployed tech heads who are citizens, these are the folks who should have priority) H1-B's get you into the states legally And you're right it is a cause for concern, but deport 'em. Maybe they are from wealthy families, as the education would indicate. My math tutor a few years back was an engineer from China, who was happy to work for the community college for $7 an hour. I am sure he was legal, but just because you have a foreign degree does not mean you get an H-1 visa which is limited to 65,000 individuals a years after all.
