Because it hadn't been linked to identity theft before...

Technically "spy-ware" is illegal... if a piece of software reports
your information to someone else's server, you're supposed to agree to
that in a licensing agreement or in the software's preferences...
Ad-ware may or may not be legal -- they get away with adware on a
technicality by putting it in the license agreement of some other
piece of software you want, like Gator and TopText. I suspect as a
whole people don't really distinguish between them, they're both evil
and therefore both removed by anti-spyware tools like Ad Aware and
SpywareBlaster.
