Technically "spy-ware" is illegal... if a piece of software reports your information to someone else's server, you're supposed to agree to that in a licensing agreement or in the software's preferences... Ad-ware may or may not be legal -- they get away with adware on a technicality by putting it in the license agreement of some other piece of software you want, like Gator and TopText.
