Academically that's true, I hear ya, but when you see the tape you'll understand. The reporter walks up to these 2 cops after having heard from another looter that "the police say it's ok". The 2 cops immediately turn away from the camera and when the reporter starts questioning one, shes walks away giving him blow off answers. Not to mention that the store is full of looters while the Police are browsing. You'd think if they were there to help they'd be clearing people out first. Instead they claim to be there to arrest looters, but there's about 30 of them ransaking the store about 20 feet away while the Police are evaluating shoes in a, "hmm, would this look good on me?"
