Well yeah, that's why he said "TOS/Yahoo/HOF has the right to take him down if they want" ... I don't think he's ignorant of the applicability of constitutional rights... I read it as expressing an opinion about the choice to censor someone even though you're well within your rights to do that as an individual in ownership of a mailing list, etc.
