I think it's more that I don't think that the Senate would not look kindly on a recess appointment to the Supreme Court when they get back in session. I'm not sure if it's legal or not though. It may be that the SC does not reconvene until October, so the Senate would be back in session and a recess appointment is moot anyway. Matthew Small
