Name-squatters are pretty common.  If you can't contact them you can contact
their registrar and lodge a complaint - although it may take legal action to
actually get the name switched.

We had a similar problem at www.firstnight.org.  Somebody purchased
"FirstNightBoston.com" and used to host an ad frame with our site framed
inside.  A frames-buster killed the misuse and a letter from the corporate
lawyer got the domain name.

In this case the name "first night" is copyrighted and the squatter was
obviously associating it with our organization for personal gain so it was
an easy sell.  In your case, with a personal name, it may be more difficult
- especially if there's a "brian meloche" on the other side.  ;^)
