I think the important thing to remember that the framers were just that.
They created a basic framework, something for later generations to change
and work with as they see fit.

Just because they claim they didn't want religion to be a part of it,
doesn't mean that they wanted to prevent an individual from thinking freely.
The Constitution does not provide guidelines for Presidential appointments.
The President can use what ever criteria he wants.

The President is one man, when we make individual choices we take in to
account anything we want. If our choice affects others, it is still our
choice.

I think the framers made it possible for the President to have this much
freedom in his appointments on purpose. Otherwise we wouldn't need
congressional review, and this is the most important process.

Bush can appoint the grand wizard of the KKK, it is the responsibly of the
Senate to scrutinize the appointment, and ensure that is what is best for
the court and the US.
