Hopefully homosexuality will never be part of the Constitution as morality
issues should not be part of that document - ever. However, I believe that the
Constituion does guarantee all Americans the right to pursue happiness which
means that as long as an individual does not infringe on the rights of another
then they have the right to believe what they want to believe, pray (or not
pray) to whatever god they choose and to have relations with any other
consenting adult.

As for the gay marriage ban - I think that a state likely does have the right
to ban gay marriage in a civil ceremony but probably does not have the right to
ban a marriage sanctioned by a religion in the state. Also, I think that there
is underlying discrimination in that a partner in a gay union is not afforded
the same rights as the spouse in a traditional marriage. So, if the state
banned marriage in civil ceremonies but partners in gay relationships got death
benefits and other rights then I would think that this would overall be
constitutional.
