I like your thinking, however my rational logic was
if I had a spare gun, use it, shoot them both and place
the gun in the hands of the hostage takers.

Indicating that he shot the hostage then turned the gun 
on himself.

You get away scott free. No lawsuits.

You are the closest, but the correct answer is, nuke them both.  It's much
more gratifying than just shooting.  Also,  you have to think about the
possibility if you shoot the hostage, they might sue.  So, nuke the hostage
 and no lawsuit.  Of course, the family might sue, so you can either nuke
them as well, or get rid of them using more traditional methods.  I would
recommend the nuke.  That way, after you take out the whole neighborhood,
you can rezone it and sell it off to commercial developers.  You gotta think
these things through :)
