That little thing called evidence. All they have right now is apparently a statement by Libby. If that's all the evidence they have, there is really no case for the prosecutor to make.
As to why they haven't said whether a crime was committed, either they haven't decided whether the leak was illegal, or they have decided it was not illegal. Remember, even Libby (who has been caught red-handed) isn't under indictment for the leak, he is under indictment for lying about it. >Interesting, why was Libby arrested if he was acting under Cheney's >orders?
