I don't think everyone taken to Gitmo is being taken there to face trial. I think they are moving some of them there for interrogation. If they feel, through previous questioning, that they know something about Al Qaesadea's network, they are probably being moved there for better and more thorough questioning. And there is the possibility that their names have popped up in someone else's intelligence.
