There's an assumption that either these people are criminals due US legal protections or non-uniformed un-elisted soldiers due, or not due, the Geneva Convention. What a total failure of thought! There's a third option: they're something else. That's my pick. Our government actually has to be innovative to create a new class, due new rights, for these people. The reason that's not happening is the same reason for all our country's current political problems: we've got a Congress, Presidency, and Judicial branch all controlled by the same party. (remember that CJ Roberts recused himself from the latest GitMo ruling because he had previously supported the President. Thus had he voted the court would've ruled in favor of the President.) If we had opposing branches of government, they'd realize that the President can't just delcare himself King and do whatever the hell he wants. They design a creative solution that creates a new set of rights for "non-governmental enemy combatants". This would include rights to imprision, trials, treatment, etc. Then they would get World support. Controversy over, problem solved. Why aren't we doing that? Single party control.
