It really comes down to bullying and threatening.  If a group is big and 
powerful enough, they can make rules for everyone else to follow, but don't 
have to follow the rules themselves.  Congress does it all the time, too.  And 
they can just be brazen about it, right out in the open, and there's nothing 
anyone can do about it.  If they place you under military arrest out of 
jurisdiction, find you guilty of whatever specification they want, then stick 
you in Leavenworth, your lawyer can jump up and down and read to both the 
military and civilian courts the clearly-worded military regulations proving 
that you're free of military jurisdiction and it won't matter.  Even if the 
civilian court finds you to be within your rights, Leavenworth physically has 
your ass, and the military courts can just sit there and tell the civilian 
courts to pound salt all they want.

The military sees it this way: "Oooooh!  The civilian courts just issued us a 
piece of paper with some words printed on it.  Big scary monsters!  Gee, what 
can I make out of that piece of paper?  I can make a cute little sailor's hat, 
or maybe an origami bird, or one of those fortune teller thingies.  Cool!  I 
guess if they really wanted this guy they'd have to break in to the best-held 
military prison in the world, use firearms to overpower the toughest trained 
soldiers in the business, and then take him away.  But they're never going to 
do that, are they?  I mean, we can just claim jurisdiction all day long and 
tell them where to stick it.  We have our rules; they have theirs.  All they're 
going to do is issue pieces of paper with words printed on them.  Kind of like 
the UN telling North Korea what to do with strong words on pieces of paper.  
And all we have to do to keep him here is decide to put his case on the bottom 
of the queue and then delay it on a technicality again when it comes to 
calendar.  Then after a year or two we just casually ask him if he would rather 
'serve his country' then stew in prison, and he jumps at the chance.  Hey -- 
we're better at this intimidation thing than the freakin' mafia!"

And that's that.

  guy, retired as a Colonel.  He got called back at 50 something, against the
