That's what I am saying.

An illegal combatant isn't a war criminal.

They are an illegal combatant.  Under the Geneva Convention they do not have
the same rights as a legal uniformed combatant.  However they are not always
war criminals, which are generally reserved for serious crimes against
humanity type issues.
