Technically, I think you're right, but in practice I usually look at
this type of situation with the assumption that lanes 1 and 3 are safe
and 2 is up for grabs by whoever can influence their way into it.

I'm MUCH more frustrated by lane 2 people who try to enter lane 1
(usually while talking on a cell phone).
