Two different things. Assault and battery are crimes, regardless of the reason (free speech protest, bad breath, wrong color bandana). Unless it also falls into a special category (elderly, hate crime), the reason does not effect the crime. It may effect the sentence, though.
Restricting speech is not a crime. I often look at our crimes and punishments as a menu. Before you act, you can see the cost for the act, and can make your decisions based on that. If you are willing to pay the price for an assault, and think it is worth the penalty and/or fines, then feel free. Of course, someone else may also order from the same menu, and your actions make the price seem more reasonable.
