The only restriction I support is a ban on the purposeful burning of a flag not 
associated with proper and respectful disposal ceremonies.  

For your examples, the flag is not included in the creamtory when a 
veteran's/soldier's body is cremated.  It is removed respectfully by the honor 
guard and given to a family member or representative.  When a ship is scuttled, 
the colors are struck and taken if at all possible when the ship is abandoned.  
If the ship is sunk, the flag is like not burnt.  Also, it is done by a non-US 
soldier and therefore not subject to the US laws.

As for speech, all I ever hear from the item when something is burnt is 
crackling.  Most burning inanimate items don't speak when burnt.

As for the burner, that person can say the same thing without desecrating the 
emblem of our nation.  The burning of the flag is perform do an outrageous 
action to draw attention to themself.  All I support is the banning of a 
particularly agregious, outrageous act.
