War Crime:

Crimes committed against an enemy, prisoners of war, or subjects in wartime 
that violate international agreements or, as in the case of genocide, are 
offenses against humanity. Acts committed by soldiers or government officials, 
either in the course of a war or in bringing on a war, that violate the customs 
of warfare. Examples of war crimes include atrocities committed against 
civilians and the mistreatment of prisoners of war.

Oh... wait, that's right. You need to declare war before you can technically 
have a prisoner of war or commit a war crime. No need to follow the Geneva 
Convention. Guantanamo Bay is lawful, since technically it's not full of 
prisoners of war. It's a vacation retreat for misplaced Muslims.
