in general you cannot sue the government for negligance. Medical malpractice may be a special case but the negligance would definitely have to be even more egregious than the already-high standard.
Bad outcomes do not prove malpractice. The doctor has to have provably made a mistake and, this is important, it has to be a mistake most doctors would not have made. Note -- I am not a lawyer and this is not a legal opinion.
