A 9-0 WIN AT THE SUPREME COURT

The students in the Supreme Court Clinic at the Northwestern
University School of Law were on the victorious side in a recent U.S.
Supreme Court decision.
Last week, the high court threw out a mandatory 15-year prison term
given to Deondery Chambers, who pleaded guilty to being a felon in
possession of a gun.

Chambers was eligible for such a long sentence because of the Armed
Career Criminal Act. The act imposes a 15-year term on an individual
convicted of being a felon in possession of a firearm if he or she has
three prior convictions "for a violent felony or serious drug offense
or both" on different occasions.

The government said one of those three priors for Chambers took place
when he failed to report for his weekend jail confinement.

Ultimately the justices ruled that failure to report for weekend jail
confinement did not constitute a violent crime.

Chambers v. U.S., No. 06-11206, was argued on Nov. 10 by Robert N.
Hochman, a partner in Sidley's Chicago office.

Hawkins said several groups of students worked on the case since 2007,
including the students who helped put together the original petition
for a writ of certiorari in May 2007 asking the high court to review
the case.
