If that's how it actually happened, I would agree with you, but they handed out this money months ago, and only now are they coming back and claiming these powers. If I were running a company that had been encouraged to take TARP funds in the Fall, I would feel like I had been trapped by a bait and switch scam, and I would be hopping mad.
At the very least I would be giving the money back, and doesn't that defeat the entire purpose of having created the TARP?
