I worked for an ISP in the late 90's.. while they could say all they want
that "we hold no responsibility for our users content", in reality, if the
ISP knowingly hosts a site that conducts illegal activity, or finds out
about a user that is performing illegal activity and doesn't report it, they
are culpable and that extends to collocation and VPS services..

All the language really covers is that "were not going to pull someone's
site because you find it offensive", and the folks that I worked for
wouldn't.

Sounds like the hosting company was informed of the illegal activity
conducted on their servers, and ignored it. If that's true, and a jury has
decided it is, then there is nothing wrong with the judgement.
